These Terms of Service ("Terms") govern your access to and use of ReachBack ("Service"), operated by ReachBack ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
ReachBack is an SMS automation platform for service businesses. The Service allows you to send appointment reminders, win-back campaigns, review requests, and quote follow-ups to your customers via SMS. You are solely responsible for all messages sent through your account.
You must be at least 18 years old and operate a legitimate business to use the Service. By agreeing to these Terms, you represent that you have the authority to bind your business to these Terms.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@tryreachback.com if you suspect unauthorized access.
By using the Service to send SMS messages, you agree to comply with all applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and all applicable carrier guidelines. Specifically, you agree that:
We reserve the right to suspend or terminate your account immediately if we reasonably believe your use of the Service violates applicable SMS regulations or carrier guidelines.
The Service is offered on a monthly subscription basis. By subscribing, you authorize us to charge your payment method on a recurring monthly basis at the rate associated with your selected plan. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice. If you do not cancel before the next billing cycle, you will be charged for the new period. Subscriptions can be cancelled at any time through your account or by contacting us.
Each plan includes a monthly message allowance as described at the time of purchase. Messages that exceed your plan's monthly limit will not be sent. Unused messages do not roll over to the following month. Upgrading your plan takes effect immediately.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
The Service and its original content, features, and functionality are and will remain the exclusive property of ReachBack. You retain ownership of all content and customer data you provide to the Service.
The Service uses third-party providers including Twilio (SMS delivery), Stripe (payment processing), and Supabase (data storage). Your use of the Service is subject to their respective terms of service. We are not responsible for the actions or policies of these third parties.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses. We do not guarantee that any specific message will be delivered, as delivery depends on carriers and recipient devices outside our control.
To the maximum extent permitted by law, ReachBack shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or loss of data, arising out of or relating to your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the three months preceding the claim.
You agree to indemnify, defend, and hold harmless ReachBack and its affiliates, officers, and employees from any claims, liabilities, damages, costs, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any applicable SMS regulations or third-party rights.
We may suspend or terminate your account at any time for violation of these Terms, non-payment, or for any other reason with or without notice. You may cancel your account at any time. Upon termination, your right to use the Service ceases immediately.
We reserve the right to update these Terms at any time. We will notify you of material changes by email or by displaying a notice in the Service. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in California.
